We sell fresh and frozen seafood products. All product descriptions are provided in good faith. Product images are for illustration purposes only; actual items may vary slightly in size, weight and appearance. All seafood items are perishable goods.

2. Pricing & Payment

All prices are displayed in New Zealand Dollars (NZD), unless otherwise stated. Prices are subject to change without prior notice. Payment must be completed at checkout before your order will be processed. We reserve the right to cancel orders if payment fails or pricing errors occur.

3. Orders & Acceptance

When you submit an order, it constitutes an offer to purchase. We reserve the right to accept or decline any order for any reason, including stock shortages, product unavailability, or errors in product or pricing information. We will notify you if your order cannot be fulfilled.

4. Delivery

Delivery service is available within New Zealand. Delivery times are estimates and not guaranteed, especially for perishable seafood. We will take reasonable steps to ensure products arrive chilled or frozen. Risk of loss and damage passes to you once the goods are delivered to your nominated delivery address.

5. Cancellation, Returns & Refunds

Perishable seafood items generally cannot be returned once delivered. If you receive damaged, spoiled or incorrect goods, you must contact us promptly with photos of the items and packaging so we can assess your claim. We may offer a refund or replacement at our discretion. Orders cannot be cancelled after dispatch.

6. User Responsibilities

You agree to provide accurate delivery and contact information. You must ensure someone is available to receive the perishable seafood at the delivery address to avoid spoilage. You may not use our website for fraudulent, unlawful or disruptive purposes.

7. Limitation of Liability

EMIL GILBERT shall not be liable for any indirect, incidental, consequential or special damages arising out of your use of our website or products. Our total liability shall not exceed the total amount you paid for your order. Nothing in these terms excludes liability under New Zealand Consumer Guarantees Act 1993.
